General Terms and Conditions (GTC)
Of The Living Circle Group Corp. («TLC Group»)
Bleicherweg 18
8002 Zurich
Switzerland
and its Hotels as defined below
Last modified on: October 28, 2026
1. SCOPE
1.1 These General Terms and Conditions (hereinafter "GTC") apply to the temporary provision of hotel rooms as accommodation and to additional services provided in connection with such accommodation at a hotel of the TLC Group, based on individual guest bookings and reservations of up to 5 rooms per booking (hereinafter "Booking/s").
1.2 For bookings made under a company ID, or for group bookings of more than 5 rooms with the same arrival and departure date, these GTC apply in addition to the separate agreements usually concluded between the hotel and the customer in such cases. In the event of any conflict between the provisions of these GTC and other terms of such a separate agreement, the provisions and terms of the separate agreement shall prevail.
1.3 The GTC are binding for all Bookings at any of the following hotels or agritourism establishments of the TLC Group (together referred to as "Hotels" and each individually as a "Hotel"):
- Alex Lake Zürich (Hotel Alex Management AG), Seestrasse 182, 8800 Thalwil (City & Lake Resort Zürich)
- Storchen Zürich (Hotel Storchen AG), Weinplatz 2, 8001 Zurich (City & Lake Resort Zürich)
- Widder Hotel (Widder Hotel AG), Rennweg 7, 8001 Zurich (City & Lake Resort Zürich)
- Château de Raymontpierre (Dozière SA, Agritourism), Château de Raymontpierre 3, 2829 Vermes
- Castello del Sole (Terreni alla Maggia SA), Terreni alla Maggia (Terreni alla Maggia SA), Via Muraccio 105, 6612 Ascona
- Cantina alla Maggia (Terreni alla Maggia SA), Via Muraccio 105, 6612 Ascona
- Bergwelt Grindelwald (Hotel Bergwelt AG), Hotel Pinte (Hotel Bergwelt AG), Bergwelt 4, 3818 Grindelwald
- Hotel Winkelried (Hotel Winkelried AG), Dorfplatz 5, 6362 Stansstad
In these GTC, the term "Customer" refers both to the guest as end customer and to the contracting party that makes the Booking.
2. CONCLUSION OF CONTRACT
2.1 After the Customer has made a Booking verbally, in writing (e.g. by email) or via a booking platform available on the Hotel's websites, the Customer receives an electronic or written confirmation from the Hotel with the details of the Booking (including room type or room category, booking dates, price and payment terms, number of guests and other booked additional services). The contract for a Booking is concluded when the Customer receives the written confirmation, and these GTC apply.
2.2 Changes or cancellations of a Booking after conclusion of the contract may only be made within the scope of these GTC, and cancellation fees may apply.
2.3 The Customer must be at least 18 years old and legally authorised to enter into contracts. All information provided by the Customer must be truthful, correct, current and complete. If a Customer books on behalf of other persons or purchases a voucher, the Customer must obtain their authorisation before acting on their behalf. The Customer shall inform the other persons of the terms applicable to the Booking and vouchers to ensure that they agree to and comply with these terms. The Customer remains responsible for paying all amounts due, for rebooking/cancellation requests and for all other matters relating to the Booking.
3. ACCOMMODATION AND OTHER SERVICES, USE OF HOTEL ROOMS AND CLIENT BELONGINGS
3.1 Upon conclusion of a booking contract, the Hotel provides the services described in the confirmation.
3.2 The Hotel may change its services for a Booking at any time without prior notice and without price adjustment, unless the change to the services is material.
3.3 Unless otherwise agreed in the confirmation or by email, the Customer has no right to be accommodated in a specific room of the booked category at the Hotel. Images of different room categories or room types are for illustration only and may vary depending on the allocation at the Hotel and the layout of individual rooms.
3.4 Additional services not included in the booking confirmation may be arranged with the Hotel and may be subject to additional fees.
3.5 The hotel room and the items, devices and facilities provided may be used by the Customer solely for their intended purpose. The Hotel accepts no liability for property damage or personal injury arising from the improper use of such items, devices and facilities. Furthermore, it is not permitted to spend the night in a hotel room with more persons than confirmed in writing and registered at check-in.
3.6 The Customer is liable for the complete repair, damage and costs of any damage in the hotel room, to items, devices and facilities caused by the Customer or their companions and identified by the Hotel. The Customer undertakes to report any damage caused by themselves or their companions to the Hotel without delay.
3.7 Unless otherwise agreed, smoking is not permitted in the Hotel or in hotel rooms. In the event of a violation, additional costs (increased cleaning effort, loss of revenue, etc.) will be charged to the Customer.
3.8 Food or beverages may not be brought into the restaurants for consumption without the Hotel's permission. Unless otherwise stated, food and beverages may be brought into the designated areas of the agritourism establishments at lunchtime without special permission.
3.9 The Customer is responsible for their own valuables and belongings and must ensure adequate insurance. The Hotel is only liable for damage or theft of property if the damage or theft was caused by the Hotel or an employee or agent of the Hotel. If valuables, larger sums of money or securities are not handed over to the Hotel for safekeeping, the Hotel is liable only for intent or gross negligence on the part of the Hotel. Any claims of the Customer lapse if the Customer does not report the loss or damage to the Hotel without delay after discovering it.
3.10 Use of a hotel parking space is subject to availability and incurs additional fees. Where the Hotel offers an electric vehicle charging service, charging depends on availability, and additional fees will be charged on top of the applicable parking fees.
3.11 The Hotel is not liable for theft or damage to vehicles or items in vehicles parked in the hotel car park, unless the theft or damage was caused by a Hotel employee.
3.12 If the maximum capacity of the booked room category permits and if requested in advance, additional persons may use existing beds, or the Hotel may prepare existing sofa beds or a baby cot. At the hotels of City & Lake Resort Zürich and at Château de Raymontpierre, children up to and including 12 years of age stay free of charge in rooms with existing beds, including breakfast, if a room category including breakfast is booked and confirmed by the Hotel. When staying at Castello del Sole, children up to and including 2 years of age stay free of charge in the parents' room with existing beds. At all hotels of the TLC Group, parents and/or the responsible guardians are at all times responsible for the safety of their children in all facilities (including and not limited to recreation areas, public hotel areas, restaurants, meeting rooms, hotel corridors, wellness facilities and swimming pools, playgrounds and beach areas). The TLC Group accepts no liability.
3.13 For all extra beds that are not existing beds when booking a room at one of the hotels of City & Lake Resort Zürich and Château de Raymontpierre, a surcharge of CHF 50 per night and bed will be charged. Not all room categories of the Hotel allow triple occupancy. For additional persons aged 12 or over, or one adult, an additional CHF 50 per person and night will be charged for breakfast. For children aged 3 or over accommodated at Castello del Sole, a fee of CHF 100 per night including breakfast and, where applicable, an extra bed will be charged. For all other persons aged 12 or over, the tourist tax is levied.
3.14 Well-behaved dogs are welcome at the Hotels and are permitted in the reception area and in the restaurants at lunchtime and in the evening, unless otherwise stated in the rules of the respective establishment. We charge CHF 35 per dog and night, excluding food.
4. PRICES, FEES, RATES AND INVOICING
4.1 The Customer undertakes to pay the agreed price for the Booking and for other additional services purchased by the Customer during the stay (such as minibar or restaurant consumption, telephone calls, etc.). If no advance payment is required or made by the Hotel or the Customer, the full amount of the Booking price and additional services is due for payment no later than when the Customer departs. Payment may be made by credit card, debit card, Twint, vouchers issued by the Hotel, or in cash.
4.2 All prices are payable in Swiss francs (CHF) including the applicable value added tax (VAT).
4.3 The conditions of the booked room rate at the time of booking apply to Bookings. These conditions are dynamic and may include different components for the same programme at different times. There is no entitlement to adjustment of a Booking due to a change in the room rate conditions, e.g. the price or the confirmed included services. The Customer then has the option to make a new Booking at the current conditions and cancel the existing Booking, whereby cancellation fees in accordance with Section 5 below may apply.
4.4 If a Booking or part of the included services cannot be provided by the Hotel, the Hotel will endeavour to arrange accommodation in a hotel of similar category and comparable quality. In addition, the Hotel will bear all costs incurred in this connection, namely accommodation including the same services originally confirmed by the Hotel, and transport to the hotel of similar category. If such unforeseen cases occur and the Hotel has arranged comparable accommodation or service, the Customer has no entitlement to any other compensation.
4.5 Room rates do not include the tourist tax (per person and night) or other applicable tourism taxes, and these taxes are charged additionally in the amount applicable at the time of the stay. If these taxes change between the booking of accommodation and the stay, prices will be adjusted accordingly.
4.6 To guarantee a Booking, the Customer must pay in advance at the time of booking or present a valid and creditworthy credit card or a valid voucher (a valid means of payment). The validity period and the amounts available on the valid means of payment should fully cover the accommodation costs including VAT and tourist tax. If the Booking is not paid in advance or no valid means of payment is provided at the time of booking, a credit application form is required to guarantee a Booking. The corresponding check requires the Hotel's approval and takes at least two weeks. Without provision of a valid means of payment or an approved credit application, the Hotel has the right to cancel a Booking or to adjust the price of a Booking at the time a valid means of payment is submitted or the credit application is checked. The Hotel reserves the right to check all Bookings already made and verify whether sufficient amounts are available on the means of payment provided (e.g. bank or credit cards); this is done by pre-authorising the value of at least one night's stay. If the transaction fails, the Hotel has the right to cancel the Booking immediately and withdraw from the contract without prior notice. The Hotel will inform the Customer of such termination and request an alternative means of payment from the Customer.
4.7 At check-in, the Hotel has the right, in addition to the room price, to authorise a flat fee per night on the credit card as a guarantee for the additional services used by the Customer. If the Customer does not wish to provide a credit card, the deposit must be paid in cash. If the Customer consumes more than the authorised or deposited amount, the Hotel may request a higher deposit. A deposit that has not been used for additional services at the time of departure will be released or refunded in cash.
5. CANCELLATION POLICY
5.1 Cancellations or rebookings may be made by contacting the Hotel by telephone, email, letter or via the online booking engine, if the Booking was made through this channel. For other channels, the cancellation must be made through the booking platform used. A telephone cancellation may be confirmed to the Customer in writing by the Hotel.
5.2 The time of receipt of the cancellation determines whether the right to cancel the Booking was exercised in time.
5.3 Unless otherwise agreed at the time of booking, the following cancellation terms apply to Customers who wish to change or cancel a Booking at a hotel of City & Lake Resort Zürich and Château de Raymontpierre.
For Bookings of 1 to 3 rooms for the same period: For a stay of up to 4 nights, cancellation or rebooking is free of charge up to 48 hours before the arrival date. For a stay of more than 5 to 14 nights, cancellation or rebooking is free of charge up to 7 days before the arrival date. For a stay of more than 14 nights, an individual agreement on cancellation options must be made with the Hotel. If a cancellation or rebooking is made later than described above, the Hotel will make every effort to resell the room so that no cancellation fee is incurred. However, if the room cannot be resold, we reserve the right to charge 100% of the total amount of the Booking.
For Bookings of 4 to 5 rooms for the same period: For a stay of up to 4 nights, cancellation or rebooking is free of charge up to 7 days before the arrival date. For a stay of more than 5 to 14 nights, cancellation or rebooking is free of charge up to 14 days before the arrival date. For Bookings of more than 4 rooms, a deposit of 50% of the Booking price must be paid at the time of booking. In the case of a timely cancellation or rebooking, this deposit will be refunded via the means of payment the Customer used for the original Booking. For stays of more than 14 nights, an individual agreement on cancellation options must be made with the Hotel. If a cancellation or rebooking is made later than described above, the Hotel will make every effort to resell the room so that no cancellation fee is incurred. However, if the room cannot be resold, we reserve the right to charge 100% of the total amount of the Booking.
5.4 Unless otherwise agreed at the time of booking, the following cancellation terms apply to Customers who wish to change or cancel a Booking at Castello del Sole. For Bookings of 1 to 5 rooms for the same period:
Cancellation or rebooking is free of charge up to 5 days before the arrival date. If a cancellation or rebooking is made later than described above, the Hotel will make every effort to resell the room so that no cancellation fee is incurred. If the room cannot be resold, we reserve the right to charge the amount of the lost room revenue up to 3 nights of the total Booking amount.
The following exception applies to Bookings of 1 to 5 rooms for the same period that were made in the months of July and August:
Cancellation or rebooking is free of charge up to 14 days before the arrival date. If a cancellation or rebooking is made later than described above, the Hotel will make every effort to resell the room so that no cancellation fee is incurred. If the room cannot be resold, we reserve the right to charge the amount of the lost room revenue up to 5 nights of the total Booking amount.
5.5 In all cases of no-show, including late arrival of the Customer (after the first day of the stay without prior notice), or early departure, the full price for the entire duration of the stay will be charged. If you do not arrive for the first night of your stay but wish to check in for the following nights, please confirm this with the Hotel before the original arrival date. If you do not confirm this, the entire Booking becomes due for payment and is cancelled.
6. HOTEL ARRIVAL AND DEPARTURE
6.1 Unless otherwise agreed, hotel rooms are available for check-in from 3:00 p.m. on the day of arrival and must be vacated by 12:00 noon (check-out) on the day of departure. An exception applies to Castello del Sole, which requires rooms to be vacated by 11:30 a.m. at the latest (check-out).
6.2 Earlier check-in and later check-out are only possible subject to availability and after prior arrangement with the Hotel.
6.3 An agreed earlier check-in or later check-out is possible on the following conditions for all hotels of City & Lake Resort Zürich and Château de Raymontpierre:
- Check-in before 12:00 noon: 100% of the actual room price for 1 night is charged
- Check-in between 12:00 and 3:00 p.m.: 50% of the actual room price for 1 night is charged
- Check-out between 12:00 and 2:00 p.m.: no additional costs
- Check-out between 2:00 and 4:00 p.m.: 50% of the actual room price for 1 night is charged
- Check-out after 4:00 p.m.: 100% of the actual room price for 1 night is charged
6.4 An agreed earlier check-in or later check-out is possible on the following conditions for Castello del Sole:
- Check-in before 12:00 noon: 100% of the actual room price for 1 night is charged
- Check-in between 12:00 and 3:00 p.m.: 50% of the actual room price for 1 night is charged
- Check-out between 12:00 and 3:00 p.m.: 30% of the actual room price for 1 night is charged
- Check-out between 3:00 and 6:00 p.m.: 50% of the actual room price for 1 night is charged
- Check-out after 6:00 p.m.: 100% of the actual room price for 1 night is charged
8. VOUCHERS
8.1 Vouchers may be purchased online as gift vouchers or, in the event of a service disruption (e.g. pursuant to Section 11.4), will be issued by the Hotel as a credit note. The following provisions of this Section apply in addition to these GTC to all vouchers and credit notes for accommodation or other additional services of the Hotels.
8.2 Vouchers may be issued as a product voucher that entitles the holder to a specific service of the Hotel (accommodation vouchers, food and beverage vouchers or wellness vouchers), or as a value voucher in the case of a credit note, which may be redeemed against various services provided and offered by the Hotel up to the maximum amount of the voucher.
8.3 Vouchers may be paid for by credit card, debit card, Twint or in cash. Vouchers issued by the Hotel as a credit note are issued as value vouchers and correspond to the amount of the credit note, which covers the value of the previously agreed services that cannot be provided due to a disruption/interruption caused by unforeseen circumstances. The Hotel's invoices for the purchase of a voucher are due immediately, and the Hotel is entitled to charge interest of 5% if the outstanding amount is not paid within 30 days of receipt of the invoice.
8.4 Product vouchers are always intended for accommodation or other services provided by the Hotel, as stated on the voucher, and may not be redeemed for other services without the prior consent of the Hotel. The services listed on the voucher at the time of sale may vary slightly depending on circumstances and specific offers at the time of redemption, but never represent a material reduction in value for the guest. If the service stated on a voucher is offered at a higher price at the time of redemption, additional costs will apply. If the service stated on the voucher is no longer available and cannot be provided for any reason, the voucher will be exchanged for a value voucher without a specified service, which can then be used for the Hotel's services available at the time of redemption. Product vouchers are in any case valid for a maximum of 12 months from the date of sale and cannot be paid out in cash, and there is no right of withdrawal for them.
8.5 All vouchers are sent to the buyer online for printing or are printed directly on site at the Hotel upon purchase with a unique security code. Although multiple printouts are possible, only the first voucher is considered the original; it may be redeemed with the corresponding security code and must be cancelled by the Hotel. If further vouchers bearing the same code are presented for redemption, there is no entitlement to the specified accommodation or service, even if the person redeeming the first voucher was not its lawful owner. Vouchers must therefore always be kept safe and may only be passed on to third parties or given as gifts with the buyer's consent. The Hotel only checks the authorisation and validity of the voucher received from the person redeeming it. If someone attempts to redeem a voucher without authorisation or presents a voucher with fraudulent intent, that person may be prosecuted for fraud or forgery.
8.6 Product vouchers that provide for a type of service specified by the Hotel are generally valid for 12 months from the issue date stated on the voucher. Value vouchers, which do not contain a service as such but represent a credit amount that the owner is entitled to redeem against various services available at the Hotel at the time of redemption, are valid for a maximum of 24 months from the date of sale. After these periods expire, the vouchers lapse, and the Hotel is no longer obliged to accept such vouchers (or credit notes) that can no longer be redeemed. Expired or lost vouchers will neither be replaced nor paid out. The Hotel is also not obliged to accept vouchers that are unpaid or not yet paid at the time of redemption.
8.7 Payments by voucher for due advance payments or payments on site are not possible. For every transaction in which a valid product or value voucher is to be used as a means of payment, a prior reservation and a written confirmation of acceptance by the Hotel are required.
9. TERMINATION / WITHDRAWAL FROM CONTRACT
9.1 If an advance payment or other payment guarantee agreed or required under Section 4 is not provided or made, even after expiry of a brief reasonable grace period set by the Hotel, the Hotel is entitled to terminate the contract immediately and withdraw from it.
9.2 Furthermore, the Hotel is entitled to terminate the contract without notice and withdraw from it if entering into, continuing or fully performing the contractual relationship is or is no longer reasonable for the Hotel, in particular if:
- force majeure or other circumstances beyond the Hotel's control make performance of the contract unreasonable;
- Bookings are made using misleading or incorrectly presented material facts (e.g. credit card misuse, false identity of the Customer or purpose of their Booking);
- the Customer has not paid outstanding and due amounts or claims of the Hotels (e.g. from previous bookings and stays);
- the Customer has seriously violated a Hotel's house rules;
- the Hotel has justified reason to assume that the use of the Hotel's services may endanger the smooth running of business, the safety or the reputation of other guests and/or the Hotel, without this being attributable to the Hotel's area of expertise or organisational area.
9.3 In the aforementioned cases, the Hotel is entitled to terminate the contract without notice and withdraw from it, without the Customer being entitled to claim damages. Any advance payments or deposits made by the Customer shall be handled in accordance with the provisions of Section 4.
10. LIABILITY OF THE HOTEL
10.1 The Hotel is in principle only liable to the Customer for damage caused intentionally or through gross negligence that arises as a direct consequence of the Hotel's failure to fulfil its contractual obligations or a material inadequate service. In any case, the amount of damage is limited to the maximum amount of the accommodation costs booked by the Customer or actually paid upon departure (excluding VAT and cash payments).
10.2 In the event of a disruption or defect in the Hotel's services, the Hotel will endeavour to remedy the situation after becoming aware of it or after a timely complaint by the Customer. The Customer shall make all reasonable efforts to remedy the disruption and keep any damage as small as possible, and shall inform the Hotel of all disruptions or damage without delay.
10.3 In the event of loss or damage to items brought along, the Hotel is likewise liable only for intent and gross negligence. Insofar as the Hotel is liable for third parties, it is also liable only for gross negligence of the third party; the Hotel's liability is excluded if the third party intentionally caused the loss or damage.
10.4 Messages, mail and parcels for the Customer are always handled with care. The Hotel takes charge of their delivery, safekeeping and, upon request and for a fee, their forwarding. Claims for damages for losses that were not caused intentionally or through gross negligence are excluded, as are third-party and consequential damages.
10.5 If the guest is provided, even for a fee, with a parking space in the hotel garage or car park, or the Hotel provides the guest with another possibility to store personal belongings, in particular personal items and luggage, etc., no custody agreement exists. The Hotel is not obliged to monitor these items. The Hotel is not liable for loss or damage to vehicles or their contents, nor to items stored in the Hotel premises, unless the Hotel, its legal representatives or vicarious agents acted with intent or gross negligence. In this case, the damage must be reported to the Hotel no later than when leaving the Hotel premises.
10.6 The Hotel's liability is expressly limited to the sum of the Hotel's public liability insurance coverage, including in particular for third-party and consequential damages. Any further liability is expressly excluded. The Hotel is not liable for losses or damages caused by force majeure.
10.7 All liability claims lapse without compensation if the Customer fails to notify the Hotel in writing without delay upon becoming aware of loss, destruction or damage.
11. FORCE MAJEURE
11.1. Neither party shall be deemed to be in breach of the contract to the extent that the fulfilment of their respective contractual obligations is prevented or significantly impeded by a force majeure event. A force majeure event shall include any cause and/or event not caused by or under control of the Hotel or the Client, including but not limited to fire, war, terrorism, snow slide, pandemic/epidemic or any health situation as well as any decision by the Swiss authorities.
11.2. In the event of a force majeure event, the Client cannot claim compensation, damages or loss of profit. In this case, the parties agree to postpone the Booking to a new possible date subject to the Hotels availability within 12 months of the postponed Booking.
11.3. If the Booking is not made up by the Client at the time of the postponed Booking the Clients entitlement to the Booking shall lapse and the Client remains obliged to pay the agreed price.
11.4. If the Hotel is unable to offer the Client an alternative date within the aforementioned period of 12 months, the Client receives a credit note in form of a value voucher with a term of 24 months. If the Client does not redeem the value voucher within the specified term, the credit note shall lapse.
11.5. The Hotel reserves the right to adjust prices according to capacity, availability and season of the year. The Client is therefore not entitled to the originally booked price, neither of any confirmed service.
12. PRIVACY
12.1. The transmission of information, including personal data of the Customer, is subject to the current data protection provisions of the TLC Group.
13. MISCELLANEOUS
13.1 We may make changes to these GTC by updating them at any time, and by your continued use of our services after any change you agree to the updated terms. All existing Bookings remain subject to the GTC that applied at the time of the Booking.
13.2. Neither the non-exercise nor the delayed exercise of a right or remedy by the TLC Group or the Hotel under these GTC or the contract or by law constitutes a waiver of this or any other right or remedy, nor does it prevent or restrict the further exercise of this or any other right or remedy.
13.3 Should any provision of these GTC or of a separate agreement be or become invalid, the remainder of the GTC and/or the agreement shall not be affected. Invalid or ineffective provisions shall be replaced by valid ones that come closest to their economic purpose.
14. PLACE OF JURISDICTION AND APPLICABLE LAW
14.1 These GTC and the agreement, as well as all disputes or claims (including non-contractual disputes or claims) arising out of or in connection with them or their subject matter or their formation, are governed exclusively by Swiss law.
14.2 The exclusive place of jurisdiction for disputes arising out of or in connection with these GTC or an agreement is the ordinary courts in Zurich, Switzerland.
